These Terms and Conditions govern the use of Doneitnow.com, (“the website”) and the purchase of any goods from it. The website is owned and operated by Lexical Ventures Pty Ltd (ABN 32 130 157 054). Acknowledgement and Acceptance of Terms & Conditions
Please note that by accessing, using or browsing this website you agree to be bound by its terms, conditions, disclaimers and limitations of liability (“Terms and Conditions”). Please read them carefully. Lexical Ventures Pty Ltd reserves the right to amend or update such terms, conditions, disclaimers and limitations of liability at any time without providing notice to you. Your usage of the site and placement of an order indicate that you acknowledge that you have read and understood these Terms and Conditions.
Limitation of Liability
Any liability of Lexical Ventures Pty Ltd or Lexical Ventures Pty Ltd associates in connection with goods or services supplied to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of Lexical Ventures Pty Ltd, be limited to:

This property may only be used for the purposes of browsing the Lexical Ventures Pty Ltd website and acquiring goods and services of Lexical Ventures Pty Ltd.
Any and all audio that is supplied by customers for the purpose of transcription remains entirely as the property of the customer. Customers retain all copyright for all audio they supply – all rights prior to uploading audio are unchanged by our service. We simply facilitate the transcription of material, that is fully owned by our customers. Therefore, the transcript that DoneItNow produces is also owned by the customer.
These Terms and Conditions are governed by the laws in force in Queensland, Australia and you irrevocably and unconditionally submit to the non-exclusive jurisdiction of the courts of Queensland, Australia and any courts, which may hear appeals from those courts.
Information Provided by You
If you purchase goods and services from Lexical Ventures Pty Ltd we may require you to provide your name, address, email address, credit card number or other details ("customer information"). We may subsequently require further details to enable the processing of any orders that you make. You agree to provide The 1920s Group Pty Ltd with current, complete and accurate customer information when asked to do so by the website or an employee of Lexical Ventures Pty Ltd.

We take every reasonable care to ensure accuracy of all products listed. However, we do not accept liability for any errors in pricing and description. Pricing and service availability is subject to change. We are a GST-registered business.
Placing and Accepting Orders
Orders will not be dispatched until payment in full has been received and Lexical Ventures Pty Ltd is satisfied with the integrity of the order.
Without limiting the operation of any other Terms and Conditions herein, Lexical Ventures Pty Ltd is not responsible for any loss or damage caused by late delivery or cancellation of an order or a product.
Placement of an order by you constitutes an offer to enter into an agreement with us ("your offer"). We will email you an Order Confirmation for the sole purpose of confirming the details of your offer. Please note that our Order Confirmation does not constitute an acceptance of your offer or reflect the status of your order in any way.
Cancellation by Us
We reserve the right not to provide goods or services, terminate membership accounts, remove or edit content or cancel orders (or part thereof) at our sole discretion at any time. Without limiting the operation of any other Terms and Conditions herein, we will not be held liable for loss or damage arising from the exercising of these rights.
Cancellation by You
If you need to cancel an order, please contact us immediately at firstname.lastname@example.org. Our agreement with you only comes into existence once we have both confirmed your order and your payment has been processed. Once we have accepted payment for an order, cancellation of the order is within our sole discretion.
Orders that cannot be cancelled will be subject to our terms, conditions and policies relating to Returns and Exchanges.
It is your obligation to enter the correct email address and contact details at time of ordering. If you enter the wrong address, we are not obliged to re-send the order to the correct address at our expense. We guarantee that we will deliver your transcription within the turnaround time specified; that is, 24 hours for the 24 hour turnaround or 96 hours for the 4 day turnaround. Without limiting the operation of any other Terms and Conditions herein, we will not accept liability for any loss or damage arising from items lost, stolen or damaged after delivery has taken place.
Returns and Exchanges
If, upon delivery of your order, you are unhappy with any portion or aspect of the transcription, there is a 7 day period upon delivery of the order in which you may dispute the accuracy, quality or similar negative attribute associated with the transcription. If a customer is not happy, we are not happy and therefore we will correct it to meet your full satisfaction free of charge. This process will continue until you are satisfied with your order. The above process must be requested by a customer within 7 days of delivery; beyond this date we have no obligation to commence the above process. Beyond the 7 day customer review period, we do not offer refunds.
Lexical Ventures Pty Ltd retains all rights, including copyrights, for all images and designs. Under no circumstances may customers copy or reproduce any of the products of Lexical Ventures Pty Ltd or any derivatives or images thereof. Subject to Lexical Ventures Pty Ltd approval, approved customers may request the DoneItNow logo for promotion of our services, website or catalogue inclusion.
Promotions and Competitions
Other Terms and Conditions not listed herein and applying to Lexical Ventures Pty Ltd promotions and competitions are incorporated into these terms and conditions. Unless expressly stated, to the extent that the other Terms and Conditions are not incompatible with the Terms and Conditions herein, the other Terms and Conditions will be in addition to the terms & conditions herein. To the extent that the other Terms and Conditions are incompatible with the Terms and Conditions herein, the other Terms and Conditions shall prevail.
Should you object to any of these Terms and Conditions (including any subsequent amendments), you must immediately discontinue using this website.
Release and Indemnity
You agree to waive any and all claims that you now have or may have in the future against Lexical Ventures Pty Ltd and Lexical Ventures Pty Ltd Associates which relate to or are incidental to any transaction.
You agree to indemnify and hold Lexical Ventures Pty Ltd harmless from and against any and all claims, loss or expense that may be incurred by Lexical Ventures Pty Ltd or Lexical Ventures Pty Ltd Associates which relate to or are incidental to the performance of its duties as described in these Terms and Conditions including all costs of defending itself against a claim by any other person and/or as a result of you taking any action or refraining from taking any action or instituting or defending any action or legal proceeding.
You further agree to indemnify and hold Lexical Ventures Pty Ltd and Lexical Ventures Pty Ltd Associates harmless from any claim made by any third party due to or arising out of your use of this website, the violation of these Terms and Conditions by you, or the infringement by you, or other users of this website, of any intellectual property or other right of any person or entity.
No agency, partnership, joint venture, or employment is created as a result of the Terms and you do not have any authority of any kind to bind Lexical Ventures Pty Ltd in any respect whatsoever. The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. Lexical Ventures Pty Ltd shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Lexical Ventures Pty Ltd’s reasonable control, including, without limitation, mechanical, electronic or communications failure or degradation (including "line-noise" interference). If any provision of the Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the Terms shall otherwise remain in full force and effect and enforceable. Lexical Ventures Pty Ltd may transfer, assign or delegate the Terms and its rights and obligations without consent. The Terms shall be governed by and construed in accordance with the laws of Queensland, as if made within Queensland between two residents thereof, and the parties submit to the exclusive jurisdiction of Queensland courts. Both parties agree that the Terms is the complete and exclusive statement of the mutual understanding of the parties and supersedes and cancels all previous written and oral agreements, communications and other understandings relating to the subject matter of the Terms, and that all modifications must be in a writing signed by both parties, except as otherwise provided herein.
